Terms of Service

These terms govern the services provided by Ascend AI Solutions (“we”, “us”, “our”), including websites, WhatsApp automation, AI automation and custom applications.
Acceptance of these terms
By engaging Ascend AI Solutions for any service, or by using a website, WhatsApp channel or application we operate, you agree to these terms. If you do not agree, please do not use our services.
Our services
We provide the following services to businesses:
- Websites and landing pages
- WhatsApp agents, chatbots and messaging automation
- AI-assisted automation for enquiries, records and follow-ups
- Custom business applications
Scope, timelines and changes
Each engagement is agreed in writing before work begins, covering what will be built, what it costs and when it will be delivered.
Work outside an agreed scope is quoted separately. Timelines assume you provide the content, access and approvals we ask for; delays in those move the delivery date.
Your responsibilities
You are responsible for the information you give us and for how you use what we build. In particular, you agree that:
- The content, logos and data you provide are yours to use, or you have permission to use them.
- You will use our services lawfully, and will not use them to send spam, unlawful, misleading or harmful content.
- You hold the necessary consents from your own customers for the messages you send them.
- You keep the login details we hand over secure.
WhatsApp and messaging rules
WhatsApp messaging is provided through the WhatsApp Business Platform, which is operated by Meta. Your use of it is also governed by Meta's terms, including the WhatsApp Business Terms of Service and the WhatsApp Business Messaging Policy.
You must obtain opt-in from a person before messaging them, and you must honour opt-out requests such as a reply of STOP. We may suspend a messaging service that appears to break these rules, or that puts our or your Meta account at risk.
Meta may change its policies, pricing or approval requirements at any time. We are not responsible for a Meta decision to restrict, suspend or reject an account, number or message template.
AI-generated responses
Some replies are generated with artificial intelligence. AI can be wrong, incomplete or unsuitable for a particular situation, and it is not a substitute for professional advice.
You are responsible for reviewing how your automation is configured and for the messages it sends on your behalf. We recommend human review for anything involving pricing commitments, legal or medical matters, or payments.
Fees and payment
Fees, payment schedule and anything billed on a recurring basis are set out in the written quote for your engagement.
Third-party costs such as domains, hosting, WhatsApp conversation charges, AI provider usage and payment gateway fees are charged by those providers and are not included unless we say so in writing.
Ownership
Your content, your brand and your business data remain yours. On full payment, you own the deliverables we build specifically for you and we hand over the accounts and logins.
We keep ownership of our own reusable tools, templates and know-how, and of anything licensed from a third party, which remains subject to that third party's licence.
Third-party platforms
Our work relies on services we do not control, including Meta and WhatsApp, hosting providers, payment providers and AI providers. Those services are governed by their own terms and may change, have outages or withdraw features.
Warranties and liability
We provide our services with reasonable care and skill. Beyond that, our services are provided as-is and we do not guarantee uninterrupted or error-free operation, or any particular business result such as a number of enquiries, rankings or sales.
To the extent permitted by law, we are not liable for indirect or consequential loss, including lost profits or lost data. Where we are liable, our total liability for a claim is limited to the fees you paid us for the service that claim relates to in the twelve months before it arose.
Nothing in these terms excludes liability that cannot be excluded under applicable law.
Termination
Either of us may end an ongoing engagement with reasonable written notice. Fees for work already completed remain payable.
We may suspend or end a service immediately if it is being used unlawfully, if it breaches Meta's policies, or if invoices remain unpaid after we have asked for payment.
Privacy

Changes to these terms
We may update these terms from time to time. When we do, we will change the date shown at the top of this page. Continuing to use our services after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of India. The courts of Hyderabad, Telangana have exclusive jurisdiction over any dispute arising from them.
